These Terms and Conditions govern purchases in the edubily® Shop of we.fit AG. Swiss law applies, Zug is the jurisdiction, 14-day voluntary right of return, free shipping from CHF 80.
These Terms and Conditions ("T&C") govern the contractual relationship between we.fit AG, Baarerstrasse 14, 6300 Zug ("Provider") and the customer for all orders in the online shop that distributes edubily® products for Switzerland.
Deviating terms and conditions of the customer shall only become part of the contract if the Provider expressly agrees to them in writing.
2. Contract Formation
The presentation of products in the online shop does not constitute a binding offer. By placing a binding order via the shopping basket, the customer makes an offer to conclude a purchase agreement.
The purchase agreement is concluded as soon as the Provider confirms the order with a separate order confirmation by email or dispatches the goods, whichever occurs first.
3. Prices and Payment Terms
All prices in the online shop are stated in Swiss Francs (CHF) and include statutory value-added tax. Shipping costs are displayed separately before the binding order is placed.
Payment is made at the customer's choice via the payment methods offered in the ordering process. All payment data is processed exclusively through certified payment service providers.
4. Delivery
Delivery is made within Switzerland and the Principality of Liechtenstein. Deliveries outside this area are only possible following prior agreement.
The expected delivery time is 1 to 3 working days from confirmation of the order. Delays due to unforeseen circumstances are reserved.
5. Retention of Title
The delivered goods remain the property of the Provider until full payment has been received.
6. Warranties
The statutory warranty provisions under Swiss law (Code of Obligations) apply. Obvious defects must be reported in writing to Kontaktformular within seven calendar days of receipt of the goods.
7. Liability
The Provider is liable in accordance with statutory provisions. Liability for slight negligence in the breach of non-essential contractual obligations is excluded to the extent permitted by law.
8. Right of Withdrawal
The customer may return ordered goods within the voluntary period of 14 days from receipt. You will find the terms and conditions in the withdrawal notice.
9. Data Protection
Information on the processing of personal data can be found in the privacy policy.
10. Applicable Law and Jurisdiction
The contractual relationship is exclusively governed by Swiss law, excluding the rules of private international law and the UN Convention on Contracts for the International Sale of Goods.
Exclusive jurisdiction is Zug, unless mandatory legal provisions provide for a different jurisdiction.
11. Severability Clause
Should individual provisions of these T&C be or become wholly or partly invalid, the validity of the remaining provisions remains unaffected.
